How Amanah Counsel Came to Be

Amanah Counsel was established in Kuala Lumpur following a recognition that a great many Malaysians approaching retirement had unresolved questions about their pension entitlements — questions that often went unasked because no appropriate channel existed for them. Employment lawyers were focused on disputes. Financial advisers were focused on investment. Nobody was sitting with retirees and working through what they were actually owed.

The founding practitioners — drawn from backgrounds in employment litigation and civil advisory — saw this gap as a meaningful one. The firm was named Amanah, the Malay word for trust and custodianship, because that is precisely what the work requires: holding a client's circumstances with care, handling their information with discretion, and offering counsel that serves them rather than the firm's own interests.

We operate from chambers in Menara Aria, in the heart of Kuala Lumpur. Our work is deliberate and our client list is not large — we take on fewer matters so that each receives the attention it deserves.

Pension Law in the Malaysian Retirement Landscape

Malaysia's retirement landscape involves several distinct frameworks operating alongside each other. The Employees Provident Fund (EPF), governed by the Employees Provident Fund Act 1991, covers the majority of private sector employees. Government servants are largely covered by the Pensions Act 1980 and administered through KWAP, the Retirement Fund Incorporated. Private retirement schemes, established under the Capital Markets and Services Act 2007, represent a third and growing category.

Within each framework, entitlements are specific and often misunderstood. EPF withdrawal rights, for instance, differ according to account type, age, and withdrawal purpose. Employer contribution obligations carry their own compliance history. For individuals who have changed employment multiple times, or who have worked across the private and public sectors, the picture can be particularly layered.

Amanah Counsel's practitioners work within all three frameworks. Our reviews do not treat pension entitlement as a single-track question — we consider the full picture of a client's working history, scheme participation, and current position before forming any view. Where disputes have arisen with scheme administrators or former employers, we are familiar with the relevant tribunals and civil procedures available to aggrieved scheme members under Malaysian law.

We are based at Menara Aria in Kuala Lumpur, centrally located for clients across the Klang Valley. Consultations may be arranged in person or by telephone, and we regularly advise clients in other states by correspondence where the matter does not require attendance.
